    Protective Orders are legal tools Arizona courts use to prevent contact, harassment, or abuse from another person. These orders are enforceable by law and can help protect you in situations involving domestic violence, harassment, or other threatening behavior.

    Once granted, a protective order can legally require the other party (the “respondent”) to:

    • Stay away from your home, workplace, school, or other specified locations.
    • Have no direct or indirect contact, including calls, texts, emails, or social media messages.
    • Surrender firearms (in cases of domestic violence).
    • Attend counseling or anger management programs.

    Violating a protective order is a criminal offense in Arizona and can result in arrest, fines, or jail time, even for a first violation. This legal measure provides victims with a real sense of protection and accountability.

    Types of Protective Orders in Arizona

    1. Order of Protection: For cases involving domestic violence where there is a qualifying relationship (e.g., spouse, partner, family member). This is the most common type of protective order in Pima County. It offers the broadest range of protections, including restrictions on firearms and emergency custody arrangements for children.
    2. Injunction Against Harassment: This is for cases where no qualifying relationship exists, but ongoing harassment is occurring. To qualify as harassment, acts must involve a pattern of behavior that would cause a reasonable person to experience emotional distress. A single isolated incident is usually not sufficient, unless it involves credible threats of violence.

    Who Can File for a Protective Order?

    In Arizona, you can file for a Protective Order if you have been the victim of:

    • Domestic violence including physical harm, threats, or intimidation.
    • Harassment, such as stalking or persistent unwanted contact.
    • Other acts that make you feel unsafe or at risk.

    You must provide evidence of the behavior, such as police reports, photos, or witness statements, to support your petition.

    Common forms of evidence that can be used in court include:

    • Text messages, voicemails, or social media posts that show threats or obsessive behavior
    • Medical records documenting any injuries
    • Photos of damaged property or injuries
    • Witness affidavits from friends, family, or colleagues who have observed the behavior
    • Records of any previous protective orders or restraining orders

    Steps to Obtain a Protective Order in Arizona

    1. File a Petition: You can submit your request at any Arizona municipal, justice, or superior court. In Tucson, most petitions are filed at Pima County Justice Courts or the Superior Court downtown. The process is free – you do not pay filing fees for protective orders.
    2. Judge Review: After your petition is filed, a judge will review it and may issue a temporary order immediately – often the same day. This order lasts until the full hearing, which usually takes place within 5-10 days.
    3. Serving the Order: Once the order has been issued, it must be served on the respondent. Typically, this is done by law enforcement or a private process server.     What is the difference between an Order of Protection and an Injunction Against Harassment in Arizona?

    The key difference is the relationship between the parties. An Order of Protection is available when there is a specific domestic relationship, such as a current or former spouse, someone you live with or have lived with, a relative, or someone with whom you share a child. An Injunction Against Harassment applies when there is no qualifying domestic relationship. It is used to stop harassment, defined as a series of acts that would cause a reasonable person to be alarmed, annoyed, or harassed.

    What evidence do I need to file for a protective order, and how do you help with it?

    The court requires evidence to support the need for an order. This can include police reports, photographs of injuries or property damage, threatening text messages, emails or voicemails, medical records, and witness contact information. My role is to help you identify what documentation is strongest, organize it effectively, and present it clearly within your petition to establish the required legal basis for the judge.

    What is the process and timeline from filing to getting a final order?

    The process begins by filing a petition with the court. A judge will review it ex parte (without the other party present) and, if the allegations meet the legal standard, will typically issue a Temporary Order immediately, which is effective once served. A hearing for a Final Order is then scheduled, usually within one to two weeks. The other party must be served notice and has the right to appear at this hearing to contest the order. I assist with preparing for and navigating this hearing.

    Can a protective order include provisions for my children or my home?

    Yes. A protective order can include various protections tailored to your situation. Beyond ordering the respondent to have no contact with you, it can also grant you exclusive use of a shared residence (granting them temporary custody), establish temporary parenting time (visitation) schedules that prioritize safety, and order the respondent to stay away from your workplace, your children’s school, or other specified locations.

    What happens if the person violates the order after it is granted?

    A violation of an Order of Protection or Injunction Against Harassment is a serious matter. You should call 911 immediately if you are in immediate danger. For non-emergency violations, contact your local law enforcement agency to report it. A violation can result in criminal charges against the respondent, potentially leading to arrest, fines, and jail time. It is crucial to document every violation with a police report.
